Access Now v. Southwest Airlines was a case where the District Court decided that the website of Southwest Airlines was not in violation of the Americans with Disabilities Act, because the ADA is concerned with things with a physical existence and thus cannot be applied to cyberspace. Judge Patricia A. Seitz found that the "virtual ticket counter" of the website was a virtual construct, and hence not a "public place of accommodation." As such, "To expand the ADA to cover 'virtual' spaces would be to create new rights without well-defined standards."
Section 508 applies to Federal Government agencies and the technology providers that sell to them. This section of the Rehabilitation Act requires that all information and communications technology (ICT) the Federal Government develops, procures, maintains and uses be accessible to people with disabilities. This ensures that federal employees with disabilities have comparable access to, and use of, information and data just like federal workers without disabilities. The law also ensures that members of the public with disabilities receive comparable access to publicly available information and services. Section 508 applies to a wide range of technology products, including computer hardware and software, websites, video/multimedia products, phone systems and copiers.
Several U.S. courts, including the United States Court of Appeals for the Ninth Circuit, have ruled that commercial websites, including those where people make online purchases, are bound by ADA regulations. The ADA calls for auxiliary aids in communication, which has been interpreted by courts as extending to online video captioning and website accessibility.
As Kevin Rivenburgh frames it, “ The ADA is the legal side, are you in compliance with the law? And accessibility is the technical or developmental side, how well can persons with disabilities access your website?” Making a website accessible means that it meets all of the WCAG 2.0 Level AA success criteria. This is where you come in. WCAG guidelines have three varying levels of accessibility: Level A, Level AA, and Level AAA. This helps you understand your website’s accessibility and the urgency of what you need to change. Level A is most urgent and includes anything that prevents a disabled user’s ability to utilize a website. Level AA refers to areas of a website that could be enhanced in some way to give the disabled user the full experience. Level AAA is the gold standard for websites and ultimately meets and expands on the standards of level A and AA.
Two agencies within the U.S. Department of Labor enforce parts of the ADA.
