Recent years have seen an uptick in federal lawsuits filed against businesses and governments, alleging that their website violates the ADA by being insufficiently accessible to people with disabilities. In 2017, there were at least 814 such lawsuits against organizations in a variety of industries, from banks and credit unions to restaurants and e-commerce websites. The defendants include small businesses as well as major corporations such as Nike, Burger King, and the Hershey Company.

Use the plugin, follow its instruction, and resolve the compliance issues identified. You’ll find that using the plugin will save you an incredible amount of time as you maintain your site’s compliance on a month-to-month basis. The best part, it identifies the compliance issues and tells you exactly which code elements are out of compliance and why! Case law has been the most helpful in illuminating the implications of the ADA for websites.There have been lawsuits involving companies like Expedia, Hotels.com, Southwest Airlines, and Target as defendants and primarily featuring accessibility organizations as plaintiffs. These cases had mixed results, but each helped clarify the ADA's jurisdiction on the web. 

Webpage designers often have aesthetic preferences and may want everyone to see their webpages in exactly the same color, size and layout. But because of their disability, many people with low vision do not see webpages the same as other people. Some see only small portions of a computer display at one time. Others cannot see text or images that are too small. Still others can only see website content if it appears in specific colors. For these reasons, many people with low vision use specific color and font settings when they access the Internet – settings that are often very different from those most people use. For example, many people with low vision need to use high contrast settings, such as bold white or yellow letters on a black background. Others need just the opposite – bold black text on a white or yellow background. And, many must use softer, more subtle color combinations.


Upon first recognizing this possible application of Title III of the ADA in 2003, the DOJ laid out a Voluntary Action Plan for government agencies and private entities, and later followed that up with a short list of recommendations in 2007. In 2010, the DOJ seemed to be picking up steam on this topic when they released a Notice of Advance Rulemaking -- stating that they were “considering revising the regulations implementing Title III of the ADA in order to establish requirements for making the goods, services...offered by public accommodations via the Internet, specifically at sites on the World Wide Web, accessible to individuals with disabilities.”

Also, Skiplinks are available that let users navigate between main areas of the page using the keyboard, and if an image doesn’t have Alt text, you’ll be alerted (you can even add ALT text without leaving this screen). Beyond that, outline effects for objects in focus mode, link underlining, and custom CSS/JS code addition are supported. To access this resourceful toolbar, just click the floating button on the screen.
Level AA is a little more significant, and makes sites accessible to people with a wider range of disabilities, including the most common barriers to use. It won't impact the look and feel of the site as much as Level AAA compliance, though it does include guidance on color contrast and error identification. Most businesses should be aiming for Level AA conformity, and it appears to reflect the level of accessibility the DOJ expects. 
Up-to-date standards are offered for checking compliance, and it provides a cost-effective way to scan a site for compliance. There's services out there where it'd cost more than $150 (the current cost of a 1 site 1 year license) for the size of the sites I'm working with. I'm very happy to see this offering in the first place, and it's even nicer to see how thorough it looks to be. Of course, it's not perfect so I'd love to see more of the WP.org listing fleshed out (the developer author/contributor mention is missing, etc.), I'd love to see the free version on GitHub (or similar for community development assistance [I have a few things I'd help with] which is very nice to see in a WP.org listing to show there's support / ongoing development for the plugin), and of course I'd love to see the server-side checker come to feature-parity with WAVE (currently WAVE is showing a few things the server-side checker doesn't have [color contrast, etc.]) Keep up the great work!
Without a definitive ruling, there is room for a difference of opinion. That’s exactly what happened in 2015 in the 9th Circuit Court of Appeals, which ruled that Netflix is not subject to Title III of the ADA because it has no physical place of business. This opinion was unpublished, meaning it is not intended to be considered legal precedent, but it certainly makes it confusing for businesses that are not sure where they stand under the ADA.

The Trump administration’s DOJ had previously promised to begin using WCAG 2.0 as its formal standard for web accessibility. However, the DOJ recently included this action as part of the department’s “inactive list,” which means that it’s not likely to be adopted in the near future. As a result, a clear standard to judge an organizations’ web accessibility will continue to be interpreted, and the number of ADA website lawsuits is not expected to slow down any time soon.


HTML tags – specific instructions understood by a web browser or screen reader. One type of HTML tag, called an “alt” tag (short for “alternative text”), is used to provide brief text descriptions of images that screen readers can understand and speak. Another type of HTML tag, called a “longdesc” tag (short for “long description”), is used to provide long text descriptions that can be spoken by screen readers.
These and other types of multimedia can present two distinct problems for people with different disabilities. People who are deaf or hard of hearing can generally see the information presented on webpages. But a deaf person or someone who is hard of hearing may not be able to hear the audio track of a video. On the other hand, persons who are blind or have low vision are frequently unable to see the video images but can hear the audio track.
ADA website compliance is about making sure that everyone has equal access to all the elements on your website and apps. That may mean you need to provide alternatives for some of the functions and content on your site in order to meet ADA website compliance standards. Here’s a quick rundown of some of the accommodations that need to be incorporated into your website to meet the ADA guidelines:

The 2014 case involving Peapod, an online grocery retailer emphasizes that being ADA compliant goes beyond your website. The settlement required Peapod to make its mobile applications accessible by March 2015 and its website accessible by September 2015. Since mobile apps are fast becoming the preferred method of online shopping, e-commerce sites must focus on app accessibility too. 
In a society in which business is increasingly conducted online, excluding businesses that sell services through the Internet from the ADA would ‘run afoul of the purposes of the ADA’” in that it would prevent “‘individuals with disabilities [from] fully enjoy[ing] the goods, services, privileges, and advantages, available indiscriminately to other members of the general public.

Most recently, however, pizza chain Domino's has been brought under suit for their website not being accessible for specialty ordering. The U.S. Supreme Court refused to review the case, instead upholding the decision of the 9th U.S. Circuit Court of Appeals who said the “alleged inaccessibility of Domino’s website and app impedes access to the goods and services of its physical pizza franchises—which are places of public accommodation.”

Many people with disabilities use assistive technology that enables them to use computers. Some assistive technology involves separate computer programs or devices, such as screen readers, text enlargement software, and computer programs that enable people to control the computer with their voice. Other assistive technology is built into computer operating systems. For example, basic accessibility features in computer operating systems enable some people with low vision to see computer displays by simply adjusting color schemes, contrast settings, and font sizes. Operating systems enable people with limited manual dexterity to move the mouse pointer using key strokes instead of a standard mouse. Many other types of assistive technology are available, and more are still being developed.
